Orders

The website allows a person (“user”) to place electronic orders (“order”) for one or more products on offer as long as such products are available and not sold out.

By placing an order with us you agree to our sales terms, conditions and policies.

These Terms constitute a binding contract between the Customer and Bikegear. The Customer acknowledges agreement and acceptance of these Terms by making a purchase, placing an order or otherwise shopping on our Website (the “Site”). These Terms are subject to change without prior notice.

Prices are listed on our website, and are subject to change without notice.

All prices INCLUDE VAT unless otherwise stated.

All prices exclude courier fees, unless otherwise stated.

A purchasing contract (“sale”) between the user and Bikegear shall be complete only once a user has placed an order and the payment has been processed fully, meaning Bikegear has received and accepted the payment.

Payment

If payment fails due to the account not existing, insufficient funds, the credit card number or other information being incorrect  the purchase will not be successful.

Reservation

Products cannot be reserved by a user to be bought at a later time. Placing an item in your cart without processing the payment for the order will not lead to a successful order being placed nor the reservation of an item(s).

If an item is listed as “on hold”, this means that a user currently has the last of these items in their Bikegear shopping cart. If their cart expires without payment being made, this item will be released back onto the website for sale.

Availability

Please note that the stock of all items on offer is limited.

Bikegear will make all reasonable attempts to ensure that product sales are brought to an end when stock runs out.

If it happens that Bikegear is unable to fulfill any order at the advertised price because stock is sold out or unavailable, Bikegear will let you know and you’ll be entitled to a reimbursement for the rand value you have paid for such product.

All pricing is subject to change. We reserve the right to make adjustments to pricing, products and service offerings for reasons including, but not limited to, changing market conditions, product discontinuation, product unavailability, manufacturer price changes and errors in advertisements.

If an error is made and a product is listed at an incorrect price, we shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and you have paid, we shall immediately issue a credit.

We make every effort to ensure the accuracy of the information published on our website.

However, the documents and graphics published on this site may contain technical inaccuracies or typographical errors. We make no representations about the suitability of the information and graphics presented on this site.

All such documents and graphics are provided “as is” without warranty of any kind.

Products and Shipping

Bikegear typically ships out orders within one business day after they have been placed (this excludes weekends & public holidays).

Bikegear will with best effort inform the person (“user”) of the Courier Company that will be used as well as tracking details and a number and/or website where the parcel can be tracked.

Bikegear will also inform the person (“user”) of the time frame of when they can expect the parcel and/or delivery.

*FREE SHIPPING does not apply to reshipping of warranty repairs/replacements.

We will not be responsible for any delays in delivery which result from any circumstances beyond our control, including without limitation, product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labour problems, acts of war, terrorism, general insurrection, acts of God or acts of any government or agency.

Termination of Suspected Fraudulent Orders

Bikegear reserves the right to cancel or refuse to fulfill any order that it suspects of being fraudulent. This includes but is not limited to instances of suspected stolen credit cards.

On occasion, a Client Concierge may request a copy of your official identification document or the front of your credit card to verify the transaction with the relevant bank. Bikegear may cancel any order where the necessary documentation is not provided in a timely manner (usually within 24 hours).

In the event of a fraudulent purchase being placed on Bikegear, cardholders will be advised to initiate a charge-back via their bank in order to be refunded.

Bikegear does not process refunds for orders suspected of being fraudulent. You must initiate a charge-back process from your bank if you wish to receive a refund.

What if I suspect fraud of my card?

Please block your card as quickly as possible by contacting your Bank Client Services or Card Fraud division, both of which are available 24/7. Once the card is blocked, you’ll no longer be able to make purchases or use it to withdraw cash.

What is 3D Secure

3D Secure provides an extra step during the online payment process to ensure that only you, the cardholder, uses your card.  Also known as Verified by Visa, MasterCard Secure Code or Amex Safekey, it allows you to enter your previously selected PIN/Password or a One Time Pin – helping your bank to know it’s really you shopping online.
Due to an additional focus on the safety of e-commerce transactions, your bank may have already registered you for the service, or you may be required to register during your next online purchase.

Why do we have 3D Secure?

South African banks and e-commerce merchants are implementing 3D Secure to help protect you, the cardholder, against unauthorized use of your card when shopping online at 3D Secure merchants.
3D Secure allows you to authenticate yourself while making an online payment, thereby minimizing the risk of someone else using your card fraudulently.

How do you sign up?

ABSA, Nedbank, Standard Bank, First National Bank . Investec and other South African banks have pre-enrolled all Visa and MasterCard credit card clients for 3D Secure. Please note: If you are an Investec cardholder, please use your credit card pin when prompted to submit the one-time password (OTP).

The benefits of 3D Secure:

Online shopping is already very secure with high levels of security and encryption whenever you use your credit card. 3D Secure is the next security layer up in that your credit card is further protected from any unauthorized use. This means that you can shop in total confidence, safe in the knowledge that your card is protected at all times.

How does it work?

If you’ve already registered or have been registered by your bank, you’ll be prompted with an additional screen requesting a One-Time PIN (OTP) or a PIN/Password. OTPs are sent to the cellphone number your bank has on record for you, while a PIN or Password is a secret code that either you have chosen when registering for 3D Secure or was provided to you by your bank at the time of issuing your card. Simply enter the OTP, PIN or password and proceed. If you’ve never registered or been registered for 3D Secure, you’ll be asked to do so when you make an online purchase. Simply follow the prompts on the screen to register.

The first time you use your 3D Secure enabled credit card for shopping online, the bank that issued your credit card will request that you verify that you are, in fact, the correct cardholder by entering your pin or OTP.

How much does it cost?

There’s no cost to you, the cardholder. Visa, MasterCard and the banks fund all SMS and other costs.

What if I don’t want to activate my credit card for 3D Secure?

If you don’t activate your credit card for 3D Secure before it becomes mandatory, you’ll be required to pay for your goods or services via alternative online payment methods supported by the merchant web site (e.g. EFT).

My card is blocked. How do I reactivate my card for 3D Secure?

This depends on your bank. However, in most cases your bank will lock your card after three unsuccessful attempts as a safety mechanism against fraud. If this occurs, please contact your bank’s help desk using the toll-free number on the back of your card.

Does every South African online retailer use 3D Secure?

The Payment Association of South Africa (PASA) made it compulsory for all merchants to be 3D Secure enabled by 28 February 2014. This is a good thing as, while it may take a few seconds longer for each transaction, it will certainly strengthen the security of online shopping via credit card.

Tips for a good 3D Secure experience

– Ensure you have the card you intend to use to pay for the transaction readily available.
– Ensure you have your cellphone with you to receive the One-Time PIN (OTP) or you know what your PIN or Password is.
– After entering your PIN/Password, the system may take a couple of seconds to authenticate your PIN/Password. This is normal – don’t close the browser.
– If you receive an error message, read the message on the screen. If you’ve entered your PIN/Password incorrectly, you’ll be allowed to retry. Although infrequent, there may also be other reasons why the transaction failed, in which case we recommend that you follow the instructions on the screen or contact your bank for further assistance.

Returns and Refunds:

Defective Items, Returns and Reimbursement

If you are dissatisfied with your purchase due to a defect, incorrect product received or other reason, you may return it to Bikegear within 30 days of delivery.

You will either receive a refund or have the product repaired or replaced, depending on the situation.

Bikegear reserves the right to refuse a refund if the item is damaged from misuse, items are missing, or if the product is altered in any way.

Cooling Off (Cancellation Policy)

Before an order is dispatched, customers are eligible to cancel their order at no charge to them, provided the items they are cancelling are not made to order or are on demand items.

These items may incur a cancellation charge. You are allowed to cancel your order within 5 days of being placed if the order has not already been dispatched.

Once an order has been dispatched, the shipping and handling fee will not be refunded. You may cancel your purchase by contacting info@bikegear.co.za or +27 (0)41 466 2553.

Cancellations requested after items have been dispatched and have been delivered, will be treated as a return. From the date of delivery you have 30 working days to return eligible items in your order for exchange or refund with no re-stocking fee.

After this 30 working day period Bikegear reserves the right to refuse a return or exchange.

Refunds

Refunds are offered as EFT in the Users account only . Refunds take 1- 5 working days to process. EFT refunds will take 2-3 working days to reflect in your account due to the reflection delay between banks.

Please note that shipping fees are not refundable.

General Conditions:

Service Disruption

Bikegear reserves the right to limit or discontinue the functionality of the site.

While we strive to be online continuously, we cannot exclude cases in which the webpage may be unavailable. In rare cases this may cause data loss.

Bikegear cannot be held liable for cross-browser incompatibilities that cause checkout or payment failures. We recommend that you browse with Google Chrome, Safari or Firefox.

Intellectual property

Bikegear and affiliates retain all copyright and other rights to services, as well as listings, information, images, videos, and databases (the “Property Protection”).

A modification, reproduction, publication, disclosure to third parties and/or exploitation of the protected property without the prior written consent is expressly prohibited by Bikegear and its affiliates.

Limitation of Liability

NEITHER BIKEGEAR NOR ITS AFFILIATES WILL BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. NEITHER BIKEGEAR NOR ITS AFFILIATES WILL BE LIABLE FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE OR THE PROVISION OF SERVICES BY THIRD PARTIES. THE CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES PROVIDED DIRECTLY BY BIKEGEAR OR ITS AFFILIATES, NEITHER BIKEGEAR NOR ITS AFFILIATES WILL BE LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE RAND AMOUNT PAID BY CUSTOMER FOR THE PRODUCT(S) OR SERVICE(S) GIVING RISE TO THE CLAIM.

Changes in General Conditions

Bikegear reserves the right to revise these terms from time to time. If you disagree with the general terms we do not recommend use of our service. You will be required to accept the T’s & C’s every time you transact on our website.

We reserve the right to ban any individual uploader or website domain from using our services for any reason.
